Terms of use and privacy policy

Dual compliance: the Swiss Federal Act on Data Protection (LPD 2023) and the GDPR (EU 2016/679). This page brings together the terms of use of the site and the privacy policy.

General terms of use

Purpose and acceptance

These General Terms of Use (GTU) govern access to the reponds.ch website and its use. By accessing the Site, the user acknowledges having read these GTU and accepts them.

Services presented

The Site presents the Réponds! service, a voice assistant based on artificial intelligence. The information presented is given for information only and may be changed without notice. Requests for a demonstration submitted through the Site do not constitute a contractual offer.

Intellectual property

All the content of the Site is protected by Swiss copyright law (LDA, the Swiss Copyright Act) and belongs to Réponds! or to its licensors. The Réponds! trade mark is the exclusive property of Réponds!.

Limitation of liability

Réponds! accepts no liability for damage arising from use of the Site, for errors or omissions in the information published, or for any event beyond its control.

Governing law

These GTU are governed by Swiss law. Any dispute is subject to the exclusive jurisdiction of the courts of Lausanne.

In accordance with the nLPD/nFADP (art. 5, minimisation), transcripts and callers' numbers are deleted automatically after 9 days by a secure nightly purge. Before the call is put through, a voice announcement informs the caller that they are about to speak to a voice assistant and that the call is recorded.

This data is not call data: it is the service rendered to the establishment, which must be able to retrieve a past reservation or order. It is anonymised after 24 months by the same nightly purge, keeping only what identifies no one (date, number of people, amount) for statistical purposes. The establishment remains the controller for the data of its own customers; Réponds! acts for it as a processor (art. 9 of the general terms and conditions).

7.5 Uploading documents (the menu)

The image is passed to our artificial intelligence sub-processor (see Article 8 and our list of sub-processors) for this extraction only, and is then not kept by Réponds!.

7.6 Payment data

Card payments are handled directly by our payment provider Stripe. Réponds! never sees and never keeps your card number; we receive only a payment confirmation and the last four digits. Stripe processes this data under its own privacy policy.

Hosting and data transfers

Data hosted in Switzerland

The site and its data are hosted with Infomaniak Network SA, a 100% Swiss host whose data centres are located in Geneva and Winterthur. This choice guarantees that your data remains on Swiss territory, in line with the requirements of the LPD 2023.

The voice infrastructure of the service (for restaurant clients) relies on specialised third-party providers (United States). Those transfers are covered by DPAs and by standard contractual clauses (SCCs) approved by the PFPD (the Swiss federal data protection authority), or by the Swiss-US Data Privacy Framework. The detailed list of our sub-processors is published on our Sub-processors page; see also our GTC: Annex C.

Cookies and audience measurement

Cookies that are strictly necessary for the Site to work (session, security) are set without your agreement, because the Site cannot work without them. No advertising cookie is set, and we do not resell any data.

We measure the audience of the public pages with Google Analytics 4, in order to know which pages are useful to you. This measurement sets cookies and sends data to Google Ireland Ltd. It starts only once you have accepted: for as long as you have not answered, or if you refuse, no Google script is loaded and no data leaves. The Site works in exactly the same way in both cases.

We have switched off advertising personalisation and the associated Google signals, and asked for your IP address to be anonymised. This measurement covers the public site only: neither your dashboard, nor your reservations, nor your calls are exposed to it.

Changing your mind: your choice is kept in your browser. Clear the site data for reponds.ch and the question will be put to you again on your next visit. You can also write to us at info@reponds.ch with any request.

Your rights

In accordance with the LPD 2023 and, where applicable, the GDPR, you have the following rights:

  • Access: obtain a copy of your data
  • Rectification: correct inaccurate data
  • Erasure: ask for your data to be deleted
  • Portability: receive your data in a structured format
  • Objection: object to processing based on legitimate interest

An appeal may be lodged with the Federal Data Protection and Information Commissioner (PFPD): edoeb.admin.ch

Security

We implement appropriate technical and organisational measures: HTTPS/TLS connection, secure hosting with access control, access restricted to authorised persons, an incident management procedure.

Governing law

This policy is governed by Swiss law (LPD 2023, OPDo). GDPR obligations apply to persons residing in the EU.
